Article 1 – Definitions

  • Lockease: The company offering the products or services, located at Colijnlaan 18, 2181 XK Hillegom, Netherlands, registered with the Chamber of Commerce under number 01166795, reachable via info@lockease.nl.

  • Consumer: The natural person who enters into an agreement with Lockease for the purchase of products or services, excluding companies or legal entities.

  • Agreement: The agreement concluded between Lockease and the consumer regarding the sale of products or provision of services, as specified in the order confirmation.

  • Product(s): Goods offered and sold by Lockease to the consumer, as described on the website or in other communications from Lockease.

  • Withdrawal Period: The period within which the consumer has the right to withdraw from the agreement without giving any reason, as set out in Article 6 of these General Terms and Conditions.

  • Right of Withdrawal: The consumer’s right to cancel the agreement within the withdrawal period without giving any reason, as described in Article 6 of these General Terms and Conditions.

  • Order: The consumer’s order of products or services with Lockease, which, once confirmed by Lockease, results in an agreement.

  • Website: Lockease’s website, accessible via www.lockease.nl, where the consumer can view and order products or services.

  • General Terms and Conditions: These General Terms and Conditions, which apply to all offers, agreements, and deliveries by Lockease.

Article 3 – Applicability

General Terms and Conditions: These General Terms and Conditions apply to all offers, agreements, deliveries, and other legal relationships between Lockease and the consumer, unless explicitly agreed otherwise in writing.

Deviations: Deviations from these General Terms and Conditions are only valid if confirmed in writing by Lockease. In that case, all other provisions remain in full force.

Acceptance: By placing an order or using Lockease’s services, the consumer accepts these General Terms and Conditions. This also applies to repeat orders unless expressly agreed otherwise.

Changes to the Terms: Lockease reserves the right to amend these General Terms and Conditions at any time. Changes take effect once the revised terms are published on the Lockease website unless stated otherwise. The consumer is deemed to have taken notice of the amended terms when placing a new order.

Applicability of Other Regulations: In addition to these General Terms and Conditions, supplementary rules may apply to specific products, services, or offers from Lockease. These supplementary terms are provided to the consumer at the time of purchase or prior to the service.

Article 4 – The Offer

Characteristics of the Offer: Lockease’s offers are always without obligation and subject to availability. Offers include a detailed description of products or services, including key features, prices, and any additional costs (such as shipping). Lockease strives to present information on the website and other communication channels as accurately and completely as possible.

Duration: The offer is valid for the period indicated on the website or other communications. If no period is specified, the offer is valid while supplies last.

Pricing: All prices are inclusive of VAT unless stated otherwise. Lockease reserves the right to adjust prices, but such changes do not affect orders already placed.

Errors in the Offer: If the offer contains an obvious error, such as an incorrect price or description, Lockease may cancel the agreement, even after the consumer has placed an order. The consumer will be notified promptly and, if applicable, offered the option to modify or cancel the order.

Availability: All offers are subject to availability. Lockease strives to keep products and services in stock but is not liable for sold-out items.

Article 5 – The Agreement

Formation: The agreement between Lockease and the consumer is concluded when the consumer places the order and Lockease confirms it. Confirmation is provided via order confirmation by email or another durable medium.

Contents: The contents of the agreement are determined by Lockease’s offer and the consumer’s accepted order, including these General Terms and Conditions. The consumer acknowledges having received and understood the terms before concluding the agreement.

Errors: Lockease may cancel or amend the agreement if there is a manifest error in the offer, such as incorrect pricing or stock. The consumer will be notified and may cancel the agreement free of charge.

Reservation of Availability: All offers are without obligation unless stated otherwise. If a product is unavailable at the time of order, Lockease will inform the consumer and offer modification or cancellation options.

Amendments: Changes to the agreement can only be made with mutual consent unless required by law or these terms.

Article 6 – Right of Withdrawal

Withdrawal Period: Consumers have 14 days to withdraw from the agreement without giving any reason.

Start of Period:

  • For products: the period starts the day the consumer or a third party designated by the consumer, not being the carrier, receives the product.

  • Multiple products in one order delivered separately: the period starts the day the last product is received.

  • Products delivered in multiple shipments/parts: the period starts the day the last shipment/part is received.

Exercise of Right:

  • The consumer must submit a clear statement to Lockease within the withdrawal period indicating the wish to withdraw.

  • The consumer may use the model withdrawal form, but this is not mandatory.

Consequences:

  • Payments will be refunded within 14 days, excluding any original delivery costs.

  • Refunds are made using the same payment method unless otherwise agreed.

  • Lockease may delay refund until products are received or proof of return is provided.

Return:

  • Products must be returned promptly, no later than 14 days after withdrawal.

  • Direct return costs are borne by the consumer, unless otherwise agreed.

Exceptions: The right of withdrawal does not apply to products/services listed in Article 10.

Article 7 – Consumer Obligations During Withdrawal Period

  • Handle products and packaging carefully.

  • Products may only be used to determine nature, features, and functionality.

  • Consumer is liable for value reduction if used beyond what is necessary.

  • Products should be returned in original state and packaging if reasonably possible.

  • All supplied accessories must be included.

Article 8 – Exercise of Withdrawal and Costs

  • Submit a clear withdrawal statement within the period.

  • Return products promptly, within 14 days, with accessories and original packaging.

  • Direct return costs are borne by the consumer, unless Lockease failed to provide mandatory withdrawal information.

  • Consumer liable for value reduction due to excessive use until Lockease receives the products.

Article 9 – Obligations of Lockease Upon Withdrawal

  • Acknowledge receipt of withdrawal notification.

  • Refund consumer payments (excluding original shipping) within 14 days using same payment method.

  • Refund may be withheld until products are received or proof of return.

  • Lockease may charge for product depreciation if misused.

  • No refund of additional costs (e.g., premium shipping).

Article 10 – Exclusion of Right of Withdrawal

  • Certain products/services are excluded:

    • Customized products

    • Perishable goods

    • Hygiene/health-sensitive items once opened

    • Sealed audio, video, or software once opened

    • Newspapers/magazines (except subscriptions)

    • Digital content not on physical media if execution began with explicit consent

  • Clear information must be provided before agreement conclusion.

  • Based on Dutch Civil Code Art. 6:230p.

Article 11 – Price

  • Prices include VAT unless stated otherwise.

  • Price changes do not affect already placed orders.

  • Shipping costs communicated separately before order.

  • Promotions valid only during specified period and stock availability.

  • Obvious pricing errors do not obligate Lockease to sell at incorrect price.

Article 12 – Performance and Additional Warranty

  • Products must comply with agreement, offer specifications, and legal requirements.

  • Warranty claims do not affect statutory rights.

  • Warranty does not cover misuse, normal wear, or external damage.

  • Extra warranties provided by Lockease or suppliers are voluntary and go beyond legal obligations.

  • Claims must be submitted in writing with evidence.

  • Lockease may repair, replace, or refund justified warranty claims.

  • Warranty void if product repaired/modified by third parties or misused.

Article 13 – Delivery and Execution

  • Lockease will handle orders with care.

  • Products delivered to consumer address via reputable carriers.

  • Delivery within 30 days unless agreed otherwise.

  • Risk of damage/loss passes to consumer upon delivery.

  • Partial deliveries allowed.

  • Incorrect address costs borne by consumer.

  • Deliveries outside Netherlands possible with prior agreement; additional costs borne by consumer.

Article 14 – Payment

  • Payment due before shipment unless agreed otherwise.

  • Payment via Lockease methods (iDEAL, credit card, bank transfer, etc.).

  • Secure payment through Wix Payments.

  • Late payment puts consumer in default; Lockease may suspend/cancel agreement.

  • Collection costs borne by consumer.

  • Product remains Lockease property until full payment.

  • Additional costs (import, shipping) borne by consumer.

Article 15 – Complaints Procedure

  • Submit complaints via email or post.

  • Acknowledgement within 2 business days.

  • Respond within 14 days; if more time needed, inform consumer.

  • Disputes may be submitted to court or European ODR platform.

  • Late complaints do not affect consumer rights if submitted within reasonable time.

Article 16 – Disputes

  • Dutch law applies to all agreements.

  • Disputes submitted exclusively to competent court in Lockease’s district, unless mandatory law states otherwise.

Article 17 – Additional or Deviating Provisions

  • Must be agreed in writing.

  • Cannot disadvantage consumer; standard terms prevail if conflict.

  • All agreements documented or on durable medium.

  • Specific products/services may have additional terms communicated before agreement.

Article 18 – Liability in Case of Theft

  • Lockease aims to provide helmet locks to avoid leaving helmets behind.

  • Use of product does not guarantee against helmet theft.

  • Lockease not liable for loss, damage, or theft of helmet.

  • Consumer responsible for additional security measures.
